These terms govern your use of HTML Email Builder, operated by WITWEB SOLUTIONS(“we”, “us”). By using the service you agree to these terms.

The service

HTML Email Builder lets you design HTML emails and export their code. The service is provided on an “as is” and “as available” basis. We may update, change or discontinue features at any time.

Accounts

Some features require an account. You are responsible for keeping your login secure and for activity under your account. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.

Acceptable use

You agree not to use the service to:

  • break any law, or infringe the rights of others;
  • send unsolicited or unlawful email. You are solely responsible for how you use the code you export, including obtaining consent and complying with the Spam Act 2003 (Cth) and any equivalent laws that apply to your recipients;
  • attempt to disrupt, reverse engineer or gain unauthorised access to the service; or
  • upload content that is malicious, harmful or unlawful.

Your content

You retain all rights to the content you create. You grant us only the limited licence needed to host, process and display that content back to you so the service can function. We do not claim ownership of your work and do not use it for any purpose other than providing the service. See our Privacy Policy.

Disclaimers and Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to those rights, we do not warrant that the service will be uninterrupted or error-free, and you are responsible for testing exported emails before you send them.

Limitation of liability

To the maximum extent permitted by law, and other than for non-excludable rights described above, we are not liable for any indirect or consequential loss, or for loss arising from your use of, or inability to use, the service or the emails you send.

Governing law

These terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of its courts.
